Toward the end of 2022, the Federal Motor Carrier Safety Administration may release a proposed rulemaking for fully-automated (autonomous) trucks, according to the head of FMCSA’s technology division. But considering the complexity of autonomous vehicles (AV) – both cars and trucks - that schedule is not locked in. Why? The USDOT maintains a technology-neutral stance, relying on the “marketplace of ideas” for advancement of technology, making the uniformity provided by federal regulations difficult to achieve. The updated emergency declaration now runs through Aug. 31, 2022. The prior emergency declaration expired on May 31, 2022. Like the previous version of the COVID-19 emergency declaration this updated FMCSA response grants motor carriers and truck drivers relief only from Federal Motor Carrier Safety Regulations Part 395.3, the maximum driving time for property-carrying vehicles, with certain restrictions.
