Even for motor carriers who do not operate LCVs, this ICR should be a timely reminder: Commercial Driver’s License classes, endorsements, and training requirements differ by type of truck and cargo. Having the right driver in the right truck is a common-sense safety step. It’s so basic that it is part of the Behavior Analysis and Safety Improvement Categories (BASICS), called Driver Fitness, in the FMCSA’s Compliance, Safety, Accountability program. This approach abandons the emphasis placed by the previous Administration on two “core” factors – the nature and degree of control over the work and the worker’s opportunity for profit or loss – which often favor independent contractors. Joining host Evan Lockridge is Steve Vaughn, director of field operations for PrePass Safety alliance, and a former commercial law enforcement chief. In fact, nuclear verdicts—those verdicts over $10 million—against trucking companies have skyrocketed 967% in the last 15 years, according to research from the American Transportation Research Institute. “That is pretty frightening. These verdicts outpace increases in health care costs and inflation,” said Paul Enos, CEO of the Nevada Trucking Association during the PrePass webinar “Rebalancing the Scales of Justice with Tactical Training in Trucking Litigation Defense.” The post How to Rebalance the Scales of Justice in Trucking and Avoid a Nuclear Verdict appeared first on PrePass. https://ift.tt/hgtYuzE The Federal Motor Carrier Safety Administration has granted a petition from the Commercial Vehicle Safety Alliance to consider requiring all interstate commercial motor vehicles to have devices installed that electronically transmit driver, carrier, and truck data. These "universal identification devices" would allow roadside enforcement to identify and perhaps even monitor the condition of drivers and CMVs on the highway. That lease should describe the equipment and specify the start and end time and date of the transfer. FMCSA rules also mandate that the acquiring carrier identify/mark the equipment as being in its service. Of equal importance to states willing to tackle the truck parking shortage was a USDOT memorandum describing in detail the funding categories where truck parking is an eligible expenditure and how states can access those funds. Party control may shift here or there. One thing the elections won’t change, though, is safety. While we in trucking focus intently on the details of government regulations, in the broad picture, those regulations have remained remarkably consistent over time regardless of the party in power.
